This comment has a wealth of information , copy it and split up into groups and re-search each topic and bring all the relevant information together .
You then should be precise in regards to the sites you have used to gather your information , and post them like crazy to all your friends in and out of Fiji and to all the blog sites . But share the work load and it won't take so long .
=================================================http://www.fiji.gov.fj/publish/page_8067.shtml
just key into google search " Fiji Government doctrine of necessity ".
=================================================
Get ready for all the bullshit to fly in from Frank's quarters when Court resumes , but read up on this 1st .
=================================================Frank originally , at the beginning of this coup , made a comparison of his actions on the 5th. of December 2006 , to the sacking of the Whitlam Government on the 11th. of November 1975 ( remembrance day )(when all fallen soldiers in fields of battle are remembered for their ultimate sacrifice )( life ! ) by Sir John Kerr , the then Governor General .
Gough Whitlam was the then Prime Minister .
Apparently Mr Whitlam was going to table in Parliament that same day , that the CIA were running Pine Gap . Pine Gap was and still does , collect data , private and non private , for the American Government . It basically was and still is part of a spy network run by the USA Government .
Mr Whitlam wanted to shut Pine Gap down !
Please read the google page on " the CIA and the sacking of the Whitlam Government " .
=================================================
Mr Whitlam and his Government were sacked because the GG , in private conversation with Sir Garfield Barwick , a High Court Judge , and cousin of the GG , decided that a personal opinion of Sir Garfield Barwick , was legal advice ! Which it wasn't , it was simply a private conversation between two relatives , the GG however , had no authority nor right , in his capacity as GG to seek opinion from anyone in the Judiciary on matters of Government . In fact , it was illegal for him in his capacity as GG to do so !
He did so , despite advise to the contrary from the PM .
From that conversation , the GG decided to sack the Government because the opposition ( headed by Malcolm Fraser ) had with-held the supply bill in the Lower House ! This meant that there was " soon going to be " no budget for the Government , for the time being . The Constitutional crisis was only in the mind of the GG .
The GG decided from a private conversation ( not legal advice ) with a High Court Judge , that there was a Constitutional crisis !
Now , the points are these : -

1/ the PM , from who the GG is directly answerable and from whom he must take advice , advised the GG that he should not talk to anyone in the Judiciary regarding the blocking of supply in the Lower House of Parliament or any other Government matters because of the " separation of powers " !
He was told that he " takes and must follow " advise from the PM .
This was not Mr Whitlam's personal view , it was Constitutional Law .
Mr.Whitlam was a Queens Council and Rhodes Scholar before entering Politics . Mr Whitlam ( like Mr Qarase ) knew the Law .
But Sir John Kerr , whom Mr. Whitlam had actually appointed to Governor General in the 1st. place , ignored the PM's advise and spoke to his cousin .
On private matters , this was okay , but on matters of Government , this was improper , inappropriate and illegal because of the separation of powers .

2/The blocking of the supply bill put the Government in the position of running out of funds to pay Civil Servants . However , despite attempts by the opposition , headed by Malcolm Fraser , to bring the Government to it's knees , Mr Whitlam decided to outsource financing from the Middle Eastern Arab Nations ( known then as petro dollars ) as they had plenty of cash available at a cheap interest rate at that time . It was all legal and within the PM's jurisdiction to have his Government do this . The Government had not yet run out of money and there was no crisis .

3/ There was no Constitutional crisis .

4/ There was no doctrine of necessity as Frank put it !
It simply didn't exist and didn't apply to this situation , just as it didn't exist in Fiji's situation in December 2006 !.

5/ The GG took matters into his own hands , was egotistical and misguided
( remind you of anyone ? ) , and had probably been drinking too much , and so decided , from a private conversation of Government matters he had with a member of the Judiciary , that he alone should take matters into his own hands and sack the Government , which he did .

6/ On Pine Gap , corporate secrets , inventions , business proposals , anything of value to the USA was and is still spied on by the American Government , through Pine Gap . The Australian Government allows the American Agency to filter all corporate secrets , private inventions etc. before even allowing the Australian Government to look at it 1st . Now since when does a Government Agency run the Government of two countries ?
=================================================
Now , your mission , should you decide to accept it , is to download all the of the following and look up in google search , all you can on the these matters . Because next week , when court resumes , Frank and his Lawyers , will try and fool you all . But if you take the time to look into these matters this weekend , you will already be informed .
So here is a list of what to look at , plus your own ideas ! I'm just trying to guide you all and make it easier and less time consuming , perhaps you could involve your Children as it's their future at stake .
=================================================
Queens Council , Rhodes Scholar , Rhodes College ( England ) , Gough Whitlam , The Dismissal , Sir John Kerr , Malcolm Fraser , the CIA and the sacking of the Whitlam Government , Pine Gap , ( the separation of powers , Fiji and Australian Governments ) , ( the doctrine of necessity , Fiji and Australian Governments ) , the High Court of Australia , Middle Eastern loans of the Whitlam Government , petro dollars , the loans affair , Sir Garfield Barwick , the Cuban missile crisis , the bay of pigs and the CIA , Robert Kennedy and the American Mafia , J Edgar Hoover , The assassination of J F K and possible CIA involvement .
=================================================
It's crucial that you know these things if you wan to follow the court case in Fiji . Frank and his poor advisers and confidence tricksters ( con men ) will try and fool you all . But they are poor liars . =================================================
I'm wondering if Peter Foster will be one of Frankinstein's advisers !

FIJI SPEAK OUT! said...

You are probably all familiar with the article covering Shameem’s response to the US’s conclusions regarding Fiji’s Human Rights abuses. At the end of my commentary I have included the links if you’d like to refresh your memory.

When I recently read the wonderful shyster Shameem’s response to the US appraisal of Fiji’s FHRC neglect in defending human rights, I nearly laughed my tea across my keyboard. The members and supporters of this regime never fail to disappoint in showing their self-enamoring & self-grandiose attitudes as they spew out what they believe to be intelligent quips and responses to the rest of the world when this regime is questioned or challenged.

She quickly spewed out what she thought was an intelligent response to the report as she attacked the US. I know plenty of Americans who can clearly see the faults and inconsistencies with their own government and its actions. But I don’t know any of them that would trade their freedom of expression, freedom of speech, freedom to assemble & freedom to disagree with and challenge those in authority for the lack of freedoms that Shameem is determined to foster in Fiji.

She so wittingly (NOT) tried to give the examples of Iraq & Gauntanamo Bay. She is comparing the actions of war to her treatment of the Fijian people by her through the FHRC?!?! She revealed a lot by using those examples. But even many of those in war are treated better than civilians in Fiji have been treated by this Military Regime.

Ok miss smarty pants, lets look at Iraq and Qauntanamo Bay, and the thousands that have been questioned and held as combatants. Lets look at percentages, the percentage of those held to the percentage of those abused. I would venture to guess that the percentage of detainees abused and murdered by the Fijian Military come much closer to that 100% mark than all of the US and its allies have come in 5 years of combat.

So to compare the treatment of war detainee to the treatment that Fiji citizens receive is very telling.

She says within the US there is “Racism in every sphere.” Huh?!! Would you care to elaborate and show proof of your accusations Shameem? We all know how diligent this Junta is on wanting proof and not making accusations unfounded or inciting. You are accusing a country that has members of 2 minorities running for the highest office in the land. When will we see anyone that doesn’t already have the Regime’s stamp of approval run for anything

“No one wants the USA to be the guardian of human rights for the rest of the world - it's like asking Dracula to guard the blood bank” lol I applaud any governments (which tend to be democratic govs) that are willing to put their neck out and be a voice for those people who are not allowed this basic right where they live. As far as Dracula and blood suckers, again look at an earlier pictorial on this site and see who the real blood sucker is. Every day this illegal regime sucks the life (literally at times) out of those it strives to crush into submission.

Something that is glaringly obvious in her response is what it lacks. It lacks answers, it lacks any accountability. She was not able to defend her actions or lack thereof as head of FHRC. She was not able to give one positive response to the evidences that were thrown her way. Just like the little dictator pictorial elsewhere on this site.. she only pointed fingers so that maybeeee the people wont see her own failure at protecting the people of Fiji. She totally missed the point. But are we surprised?

Instead she denies there was a coup and supports and encourages the hunting down and punishment of any who try to question or express disagreement with the Junta’s agenda. For a regime who is so concerned about “statements of aggression”, they sure are doing an ace job of doing it themselves. In fact, I’ve noticed they have committed each and every sin they’ve accused everyone else of, except to a greater degree.

Sooooo… to the shyster Shameem’s outburst of ignorance I have to laugh as once again they show their true colors. She is an imposter pretending to care or to uphold what the FHRC is supposed to stand for. Her hypocritical actions reflect poorly on the others in the FHRC and the Fijian’s who truly care and understand what human rights are.

Look here for links on her response: http://news.google.com/news?hl=en&tab=wn&q=fiji+human+rights&btnG=Search

I'l bet that when the time is right , shaista and her cronnies will want Human Rights to be applied to their own plight , when they are tried for treason etc.

I think you are right! They will all be screaming FOUL if they get 1/2 the treatment that they've given others. All of a sudden dialog and compromise is going to look very appealing to those who are dictating now.

"Live by the sword, die by the sword." I do hope they are given the same treatment that they have meted out to those that haven't even broken any laws, but only guilty of trying to have a voice. Something Frankie was offered many times before the coup, but not what he was interested in. It was too critical that he proceed no matter what. It wasnt for the people, it was to cover what was just the stop the investigation of his own crimes. His list of sins has only grown.

But youre right, they will prob all be the first to start crying about human rights and justice. But lets make up our own rules as we go along.. just like they did.

Unable to get into Fiji Times online , I am posting my comment here !
I think it's called clutching at straws . There are two things yet to happen , which could benefit the regime .
1/ the 1st is to close down or censor the media , so this may be their excuse don't you think ?
2/ the 2nd would be to accuse Mr Qarase of inciting ? anything as an excuse to have him detained or arrested . The reason , the inevitable outcome of this Court Case presently before the High Court .
One can assume that if the court finds in Mr Qarase's favour , that Frank and his buddies know that jail will be their final resting place . I believe this is the motivation behind these false allegations against the Fiji Times and Mr Qarase and they won't go down without a fight , it seems !
